Role purpose
The China Biotech Intellectual Property (IP) team lead, serves as the senior IP leader responsible for developing and implementing intellectual property strategy for biotechnology developed by the China R&D team. Leadership and implementation of the IP strategy supports business objectives, innovation programs, commercial activities, and long-term value creation. The role ensures that there is strategic legal and IP leadership across R&D, commercial, licensing, business development, and regulatory functions for Seeds biotechnologies, while ensuring effective protection, enforcement, and monetization of the company's intellectual property assets.
The position partners closely with global IP leadership, China business leaders, research and development organizations, external counsel, and government stakeholders to maximize the value of the company's intellectual property portfolio and maintain freedom to operate in China and effective protection strategies globally.
Accountabilities:
• IP Strategy Leadership
• Develop and execute comprehensive China intellectual property strategies aligned with business priorities and global IP objectives.
• Provide strategic counseling to business and R&D leaders regarding intellectual property risks and opportunities.
• Ensure IP considerations are integrated into research, product development, licensing, collaboration, and commercial decision making.
• Identify opportunities to leverage intellectual property to support competitive ad-vantage and growth.
• Portfolio Management
• Direct development, protection, maintenance, and optimization of patent, plant variety, trade secret, trademark, and related IP portfolios for biotechnologies within China.
• Collaborate effectively with Global Seeds IP team to maintain China inventions globally.
• Establish portfolio priorities based on business strategy, competitive positioning, and innovation pipelines.
• Coordinate invention harvesting and invention disclosure processes with R&D teams.
• Work closely with internal and external patent practitioners to manage patent preparation, filing, prosecution, and lifecycle management activities.
• Business and Innovation Support
• Serve as primary IP advisor to China biotechnology organization
• Support strategic technology initiatives, licensing activities, collaborations, acquisitions, joint ventures, and other business transactions with a primary focus on biotechnology.
• Provide freedom-to-operate assessments and strategic guidance for technologies in the development pipeline and commercial biotechnology products.
• Support partnerships and innovation collaborations involving Chinese institutions, companies, and research organizations.
• Enforcement and Risk Management
• Develop and implement strategies to protect company intellectual property rights for Seed biotechnologies in China.
• Oversee enforcement actions involving patents, trademarks, trade secrets, and related intellectual property rights for the China seed biotechnology portfolio.
• Manage disputes, opposition proceedings, invalidity actions, and litigation in coordination with legal leadership and outside counsel.
• Monitor competitor activities and emerging legal developments impacting the business.
• Team Leadership
• Lead and develop the China Biotech IP team, including attorneys, patent professionals, and support personnel as appropriate.
• Manage resources to support key business priorities.
• Foster collaboration with global IP teams and regional legal organizations.
• Develop talent and succession planning within the China IP organization.
任职条件
Education
• Juris Doctor, LL.M., Ph.D., Master's degree, or equivalent advanced degree in law, life sciences, biotech-nology, agriculture, chemistry, engineering, or related field.
• Qualification as a patent attorney, attorney-at-law, or equivalent professional credential preferred.
Experience
• Significant experience managing intellectual property portfolios and strategies.
• Experience supporting research-intensive and innovation-driven organizations.
• Demonstrated expertise in Chinese intellectual property law and practice.
• Experience leading cross-functional teams and working with senior business leaders.
• Experience managing external counsel and complex IP matters.
